COLUMBUS, OHIO -- OCTOBER

Today, the Ohio Elections Commission held a panel hearing to determine if
there was sufficient evidence and probable cause to refer the complaint
filed by the Friends of Seth Morgan on October 24, 2008 to the full Ohio
Elections Commission.
The panel found that indeed there was probable cause that
the campaign of Chuck Morton, candidate for the Ohio House of
Representatives, 36th District and opponent to Seth Morgan, was in
violation of Ohio Revised Code 3517.21(B)(10).
The Friends of Seth Morgan's complaint related to an
automated phone call that was initiated by the Chuck Morton campaign
claiming that Seth Morgan home-schools his children and implies that Morgan
therefore cannot properly reform public education.
While Morgan does support parental choice in education and
is a home-school graduate himself, Morgan's only school-aged child attends
public school in Huber Heights.
Attorney Rob Gurry, of Gurry Law, LLC in Miami Township is
co-counsel and represented the Friends of Seth Morgan at the hearing and
indicated that he expects full victory and vindication when the full
Commission meets on Monday, November 3, 2008.
After the panel hearing Gurry said..."This is
exactly the type of blatant disregard for the truth the law is designed to
prohibit and punish. It is unfortunate that the Chuck Morton campaign
resorted to spreading outright falsehoods, especially when Chuck Morton
attended a forum where Mr. Morgan stated unequivically that his daughter
attends Huber Heights Public Schools. I expect that we will continue to win
this case when it moves to the full commission."
Leslie Klick, Campaign Manager for the Friends of Seth
Morgan said "...we are pleased with the findings of the panel
today. This type of disregard by Mr. Morton is exactly what voters hate
about elections, and it should be exposed and stopped. Today we took
another step towards doing just that."
